SomBuyAndRent – Terms & Conditions Effective Date: 25 October 2025 

1. Introduction Welcome to SomBuyAndRent (the “Platform”), operated by SomBuyAndRent Ltd (“the Company”, “we”, “us”, “our”), headquartered at Airport Road Km4, P.O. Box 114, Mogadishu, Somalia. By accessing or using our website https://sombuyandrent.com and related services (“Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you don’t accept these Terms, you must stop using the Services. 

2. Eligibility & Account Registration - You must be at least 18 years old to use the Services. - You agree to provide accurate, current and complete information when you register, and to update it if it changes. - You’re responsible for maintaining confidentiality of your account credentials and for all activity under your account. - We may suspend or terminate accounts that violate these Terms or present risk. 

3. Our Role - SomBuyAndRent is a property listings marketplace connecting users who wish to buy, rent, or sell properties. - We are not a real estate broker, agent, lender, or advisor. - We do not guarantee the accuracy, completeness or merchantability of the listings provided by users or third-parties. 

4. User Content & Listings - You may upload listings, images, videos, text and other materials (“User Content”). - By uploading User Content, you grant SomBuyAndRent Ltd a worldwide, perpetual, royalty-free, non-exclusive licence to use, copy, display, modify, distribute and publish your User Content in connection with the Service. - You represent and warrant that you hold all necessary rights, consents and permissions to upload the User Content and permit the rights granted here. - We reserve the right to remove or modify any listing or User Content at our discretion without notice. 

5. Prohibited Conduct You agree not to: - Use the Services for unlawful purposes or in a manner that infringes the rights of others. - Upload false, misleading or fraudulent content. - Use bots, crawlers, scraping tools or automated means to access or extract data from the Services. - Impersonate another person or entity. - Remove or alter any copyright or other intellectual-property notice on the Services. - Advertise or resell access to the Services without our express written permission. 

6. Fees, Payments & Refunds - Some features (for example, premium listings or featured placements) may require payment of fees in U.S. Dollars (USD). - All fees are non-refundable unless explicitly specified. - Payment processing is handled by authorized third-party payment providers. - We may change the fee structure at any time; we will publish notice of changes on the Platform. - If you don’t agree to a new fee you must discontinue the paid service. 

7. Intellectual Property - The Platform, all its content, design, graphics, logos, software and trademarks (“Company IP”) remain the sole property of SomBuyAndRent Ltd. - You may not copy, reproduce, publish or exploit the Company IP without our prior written consent. 

8. Disclaimer & Limitation of Liability - The Services are provided on an “as-is” and “as available” basis. We make no representation or warranty of any kind. - We do not guarantee uninterrupted access, timely updates or error-free operation. - To the maximum extent permitted under applicable law, SomBuyAndRent Ltd shall not be liable for: - any indirect, incidental, special or consequential damages; - loss of profit, business, goodwill, data or opportunity; - any claim arising from your use or inability to use the Services or from transactions between users. - If local law prohibits exclusion of certain liabilities, those exclusions will apply to the fullest extent permitted. 

9. Indemnification You agree to defend, indemnify and hold harmless SomBuyAndRent Ltd, its affiliates, officers, directors, employees, agents and licensors from and against any and all claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from: - your use of the Services; - your violation of these Terms; - your User Content; - your transactions with other users of the Platform. 

10. Suspension & Termination - We may suspend or terminate your account or access to the Services at any time if you breach these Terms or if we believe you pose a risk to the Platform. - On termination, your rights to use the Services end immediately. - Sections 4 (User Content), 7 (Intellectual Property), 8 (Limitation of Liability), 9 (Indemnification) and this Section 10 will survive termination. 

11. Governing Law & Dispute Resolution - These Terms shall be governed by the laws of the Federal Republic of Somalia. - Disputes arising out of or relating to these Terms shall be submitted to the courts of Mogadishu, Somalia. - Before formal legal action, we encourage you to contact our support team for informal resolution. 

12. Changes to these Terms - We may update these Terms from time to time. If we make significant changes, we’ll post a notice on the Platform or send you an email. - Your continued use of the Services after changes means you accept the updated Terms.
